User Agreement

Article 1. Introduction

All policies and rules on the site constitute an integral part of this agreement, forming its appendix.

Article 2. Definitions

The definitions to be used within the scope of this agreement and the meanings represented by these definitions are as follows:

Site: The entirety of internet pages consisting of the domain name www.jinepsantique.com and its subdomains.
Jineps Antique: The owner of the Site, the operator of the site, and the person or persons authorized to manage the Site located at Yavuz Sultan Selim Mah. Körfezkent 1. Etap A6 D:17 Körfez / Kocaeli address, which has all rights.
User: Individuals or entities or systems benefiting from the services on the site without registration.
Buyer: Users who purchase the products offered by Jineps Antique on the Site, make purchases of the products, and/or place orders.
Secure Shopping: All services provided on the Site regarding the entire process of shopping between the Buyer and Jineps Antique within the terms specified in this agreement on the Site.
Product: Goods offered for sale by Jineps Antique on the Site, for which Jineps Antique has legal liability and ownership.

Article 3. Parties

This agreement becomes valid in any use case of the Site between the Site operated by Jineps Antique and the individuals or legal entities defined as Users and Buyers.

Users and Buyers are deemed to have read the entire agreement, fully understood its content, and legally accepted all its provisions by using the Site.

Article 4. Registration and Membership Conditions

There are no prerequisites for Users. The use of the Site is entirely the responsibility of the Users.

Users can subscribe to the Jineps Antique newsletter by entering their email addresses in the "E-bulletin" section on the homepage of the Site.

Buyers can add the Products they want to purchase to their own baskets by clicking the "Add to Cart" button on the Product detail page without any pre-registration requirement. To complete the purchase and make payment, it is mandatory to fill out the order form after clicking the "Make Payment" button, and Buyers can place orders by providing this information completely.

The responsibility for ensuring that the email address belonging to the User entered during the e-bulletin registration and the information provided to the Site during the ordering process reflect the truth belongs to the individuals/entities providing the information.

Article 5. Rights and Obligations of Users

It is the responsibility of the User to protect the profile login information (username, email, password) created after the order, from their own negligence and faults. Jineps Antique is not directly or indirectly responsible for damages arising from the negligence and faults of the User. Users acknowledge and undertake that the information they declare within the Site is correct and lawful. Jineps Antique is not obliged to guarantee that the user information entered into the system and modified in the system by the Users is correct and lawful. Jineps Antique is not responsible for any damages that may arise due to the incorrectness of such information and content.

Users who benefit from the services offered by the Site may perform transactions on the Site for lawful purposes. Users are solely responsible for the legal and criminal liability in all transactions and actions made by Users within the Site. Users undertake not to reproduce, distribute, or process the information published on the Site that may infringe on the personal rights or property or commercial interests of Jineps Antique, Site, and/or other Users in a way that would constitute an infringement.

Jineps Antique is not liable for any legal problems that may arise due to the services provided by third parties and the content published by them on the Site, including Users. The accuracy and legality of all kinds of information and content provided by Users on the Site are the responsibility of the content creators.

Users must use the opportunities provided on the Site for the transactions related to the purchase of Products offered for sale by Jineps Antique and must not use any third-party software, system, or intermediary for shopping.

Article 6. Rights and Obligations of Buyers

The Products to be purchased by the Buyer on the Site are added to the basket by the User, and the information requested by the Site for the completion of the shopping is completed by the User in a complete manner. The Buyer is responsible for the legality and accuracy of the information entered during the shopping. The Buyer makes the payment for the Products subject to purchase using the payment options offered by the Site. After the payment is completed, the Buyer becomes entitled to receive the products that are the subject of the purchase and for which payment has been made.

All terms applicable to ordering, order cancellation, and product return of Buyers are specified in the Distance Sales Agreement, which the Buyers will approve before placing an order. Buyers agree to comply with these terms.

Article 7. Rights and Obligations of Jineps Antique

Jineps Antique reserves the right to modify the services and content provided on the Site, to remove the information and content registered by Users and Buyers from publication, and to use this right without the need for notice or warning. Jineps Antique has the right to remove content that is deemed inappropriate for the Site's content, evaluated by Jineps Antique, that may lead to legal problems, that is not in accordance with morality and social rules, or that does not carry responsibility for personal rights, to suspend and close the User account who owns the content, and to initiate legal and judicial follow-up when necessary.

All responsibilities that may arise due to the failure to fulfill the requests for changes, corrections, and information requested by Jineps Antique from Users and Buyers are the responsibility of the relevant Users and Buyers. Jineps Antique has the right to take any action, such as termination of the contract, freezing of the registration, cancellation of the registration, removal of the content from publication, if the requested information is not provided after the transmission of the requested information.

Jineps Antique may use the User information on the Site for ensuring security, fulfilling the obligations of the Site, and improving and enhancing the services provided.

Jineps Antique undertakes that the Product information and images to be presented for sale on the Site will reflect the current state of the Product accurately.

Jineps Antique undertakes not to offer Products falling within the scope of Prohibited Products for sale on the Site.

Jineps Antique accepts and undertakes that it will be responsible for all consequences such as order return, cancellation, damage/loss, compensation, penalty, etc. that may arise due to the Product information and images not reflecting the truth, being prohibited or objectionable Product, constituting a violation of copyright, or violating the personal rights of third parties.

Jineps Antique agrees and undertakes that all tax liability of the Products sold on the Site will belong to itself, and it will not be responsible for any tax arising from the sales amounts of the Buyers.

The approval and validity of this agreement do not establish a partnership or employer-employee relationship between Jineps Antique and Users/Buyers.

Article 8. Scope of Services, Products, and Content on the Site

Jineps Antique.shop is an online store that sells products and/or services over the internet. It is the owner and seller of the products and/or services listed on the Site. The scope of the Site includes collections, hobbies, antiques, and art.

Jineps Antique reserves the right to make changes within the scope of the Site.

Article 9. Prohibited Products

Products and/or services that are prohibited from sale according to the prohibited product list or will be prohibited in the future according to legal regulations cannot be offered for sale. Except for the prohibited product list provided below, Jineps Antique bears all responsibility for the sale of prohibited products as specified by law.

Products subject to government permission for sale
Alcoholic beverages
Firearms and knives
Military equipment
Stolen goods
Listening devices
Smuggled and prohibited import products
Cultural and natural assets
Lock picks and lock opening tools
Pornographic materials
Official uniforms and uniforms
Products that should be sold with a tax stamp but are sold without one, counterfeit or unauthorized printed books, and other products
Counterfeit, imitation, or replica products (Products in the Antique-Art category can be offered for sale with this condition if there are no legal issues)
TV decoders and encrypted broadcast decoders
Tobacco products & electronic cigarettes
Drugs and tools enabling drug use
Goods not suitable for the nature of the product and within the scope of the Site
Flammable and explosive materials
Prohibited publications
Prescription drugs, lenses, products containing indication information
Veterinary medical products

Article 10. Services

The services provided on the Site include the publication of Product information within the scope, searching within Products and titles, and 100% Secure Shopping service.

Users are free to access the Product information and search on the Site, provided that they comply with the rules specified in this Agreement.

Users and Buyers can benefit from the 100% Secure Shopping service provided on the Site, using the tools, methods, and payment options offered on the Site, by fulfilling the requirements of this agreement.

Article 11. Fees

Becoming a User on the Site is free.

Unless otherwise stated, all fees will be charged and collected in Turkish Lira.

Jineps Antique reserves the right to determine and revise the scope and fees of the Products and/or services offered on the Site according to changing conditions. Jineps Antique is responsible for publishing current fees on the internet site and announcing any fee changes to existing customers at least 1 month in advance.

Article 12. Privacy

The terms applicable to the use of the Site and the services provided on the Site are specified under the Privacy Policy heading. Users and Buyers agree to comply with these terms.

Article 13. Intellectual Property Rights

The Intellectual Property rights of all text, visual, and auditory content published on the Site by Jineps Antique belong to Jineps Antique. None of these elements may be copied, distributed, or reproduced without the permission and approval of Jineps Antique.

Article 14. Termination

Either party may unilaterally terminate this agreement and its appendices at any time. In the event of such termination, the parties shall mutually fulfill the rights and obligations accrued until the termination date. In case Jineps Antique unilaterally terminates this agreement, there is no obligation to pay any compensation.

Jineps Antique may unilaterally terminate the agreement and the memberships of Users or Buyers immediately in case of breach of this agreement and its appendices by the contracting parties. In this case, Users or Buyers are responsible for all damages that Jineps Antique has suffered or may suffer.

Article 15. Disputes

In the resolution and interpretation of legal disputes arising from the implementation and interpretation of this agreement, Turkish Law shall apply. In case of any disputes arising between the parties due to the interpretation or implementation of the provisions of this agreement, Istanbul Courts and Enforcement Offices shall have jurisdiction.

Article 16. Duration and Effectiveness

This agreement becomes effective upon the User or Buyer starting to use the Site and remains valid for the duration of the use of the services on the Site. After the use of the services on the Site, the provisions of this agreement will bind the parties in all legal processes related to the use.
